TOS (Terms of service)Before commissioning me, read carefully all the information.By commissioning me you are agree with my TOS. I have the right to change, add, remove, complete etc, any term at my discretion. I will never change something affecting the current customers, all changes will only apply for future commissions.1. 11. Epilogue1. Rules and other important things:- All commissions are only for PERSONAL USE.- NO RETRACTIONS, after you ask to buy any adopt, YCH. Unless you have an extreme emergency, I won’t tolerate it.- I reserve the right to decline any kind of offer, negotiation, commission, etc.- You are paying me to draw something for you. I won’t give you the rights of the picture itself. Please credit me as the artist.- If you resell any adopt or custom, it needs to be for the SAME price or LOWER than as you bought it, + the extra art.- Minor changes are allowed to the commission however if it is a large change than you will have to pay extra. This is with the understanding that it was not a misunderstanding or error on my part.- Always fill the order form provided in all my commissions. I have the right to decline the ones that didn’t fill it.- You CANT trace, edit, copy, heavy reference, steal, etc my art, adopts, ych, etc.2. What I CAN / CAN’T DrawIf anything isn’t mentioned here, please ask, in some cases i can make an exception, that need to be asked before send the order information.I can draw:- Any Gender Identification- Humans, Anthros, Animals- Any Body style- Mild Blood or Gore- Any age (for minor characters I will not draw NSFW or anything sexual)I can't draw:- NSFW- Heavily complex designs without proper reference (I will let you know if I am unable to draw them)- Rape / Torture- Anything hateful to any Gender, Race, Orientation, Religion.- Fanart- Anything else I feel I am unable to draw (I will let you know)3. Prices and discountsAll prices are decided by me, none can be changed unless I decided that. Prices can change at any moment (can up or down) for any kind of commission (YCH, adopts, customs, normal commission, etc) But the new price will only affect future commissions
(Any current customer (someone that already bought a slot) will keep the price when they bought the commission).Discounts can only apply for a new commission. If I add a new discount or offer AFTER you already bought the commission, the discount will NOT be applied. (If you requested a commission coincidentally the same day I announced the discount then you can request the discount. I will only apply it if you request it.)The price, discounts and offers need to be agreed on by both the customer and I before I will accept the commission. This specially applies for extras or things that can get the price higher.4. Payment and Payment methodsI only take payments via Paypal, Venmo, Cashapp and in USD (all my prices are in USD dollars). The payment will be through invoice always, unless we discussed it first.The Invoice; will be sent after I show you a WIP of the art piece. The full size art will NOT be sent if i do not receive the payment first.You have 3 days to send the payment after the invoice was sent, after that, i will send you a reminder giving only 1 day more.If you need extra time to pay, please always send me a message before the time I give is over. We can talk about how much time you need, why, and how much time extra I can give you.If you have the payment but get an emergency, you can cancel the commission ONLY BEFORE I STARTED IT, otherwise, you will need to pay at least for the percentage i have finished. If want some extra time to pay the full commission instead, we can discuss it.For commissions over $100 i can do a payment plan, but this need to be discussed before the commission is accepted.5. RefundsIf I’m unable to complete the commission for any reason, I will send you a message; I will refund you.I reserve the right to cancel a commission at any time, due to personal reasons, poor communication between the customer and myself, rude or disrespectful treatment, an inappropriate treatment that results in me feeling uncomfortable, etc. If the payment was taken upfront, I will do a refund based on how much I completed.I WON’T DO any kind of refund after the art piece, YCH, Custom, Adopt, was finished and sent. When the work is done, the transaction is too. This applies too for premade adoptables. After you sent the payment and I sent the finished piece, I wont refund you.6. Edits and alterationsA WIP of the sketch will be sent before I continue with the lineart/coloring/shading/etc. This is when you can ask for any change in the commission. If you ask for a full new sketch, will be an extra cost depending on the type of commission. (Sketch cost of commission type in addition.)After that, if you ask for more WIPs of my progress, any changes asked in that time need to be only because I messed up something (forgot add a detail that was in reference, forgot add any color, or shaded some part, etc). It will be fixed without extra cost.If you ask for any change that wasn’t mentioned before by you, it will be considered an extra (like, you thought other color would be better, have a different idea until now, etc) and will represent an extra cost, added to the final price. (this will be discussed before I do any change)I won’t do changes of things that are not part of my art style. (ie: requesting I make the eyes a different shape or shade a different way)All changes after the art piece is done, need to be asked before you send the payment and I send the full-size. Changes made here that are not a mistake on my behalf will cost extra.I will not alter your work after the transaction is complete.You CAN’T for any reason edit, alterate, re-draw, or anything along those lines my finished commission for you.7. DeadlinesI don’t have any set deadline, because all are based on which and how many commissions I have as well as schooling. But you can always ask me an approx. This can change if i get any personal problem (like illness, family passed away, etc).I try to work in my commissions in order of which they were taken (you can check or ask for my to do list always) Commissions that are at the bottom of my list, will take longer than others (for obvious reasons), so take that in mind.If you need your art piece finished by a certain date, ask me before leave the order info. Depending on my current situations, I can do it no problem, but in other cases you will need to pay an extra fee (starting at $10) this will be based on the type of commission and when you need it to be done.In extreme cases, even if you can pay the extra fee, if I don’t feel I can finish it in your requested time, I will need to decline. (this applies to commissions that are too complicated, when I don’t have extra time, etc)I always try to finish the commissions as fast as I can, but you need to take in mind that i like take my time to do a good work, that personal and random things happens always and we cant control them. For that reason if I’m taking more time than I expected, I will send you a message, asking for patience and show you a WIP if is necessary, or you can send me a message asking for it.8. How I WorkEven when I work in order of my to do list, if I am waiting for your approval on something (Discussion of pricing, Request for additions, etc.), I will work in something else while I wait.If for any reason I do any commission before yours, even when they were after you in my to do list, consider that they might have paid to have it done faster- or that your design was more complex- fear not because your’s will be completed!9. Rules for Specific Art CategoriesCustoms - For all the customs you will need fill an order form provided by me, they need to have pics as reference + text (if necessary). Only text without picture reference will be declined. They need to be detailed and clear. The price will be based on what you want and we need to agree the price before i start. I don’t use base for them, so take that in mind. I can do gijinkas and MYO slots (send proof of the MYO slot always). you cant make other adopt based of the one i did (for example, change their hair color and said is other character) You can change outfit and hairstyle, etc of your character but it CANT be done over my art, the character design still need to give credit to me, so each art and alterations need their correspondent credit to how draw or edited it. Other rules in this TOS apply for it too.YCH - For all YCHs, fill the order form provided for the specific pose. You CAN’T copy, heavy reference, use, edit, (etc) my YCH for any reason. All YCH will be only for 1 slot, unless stated otherwise, or if it was discussed by the artist and the person that bought it. (Such as a deal or offer)Adopts -
- The fullsize only will be sent after you pay the invoice,
- You CAN’T copy, trace, modify, heavy reference, etc my art.
- Always respect my own closed species if the adopt is one.
- Any change on my design need to be done in another art piece (or you can pay an extra so i can do it on the original art)
- If you do changes on the design, remember that the original design is still linked to the one with the changes and both need to be sold together for the same price or lower then when you bought from me.
- You can resell, gift or trade the design (for the same or lower price as bought + the extra art
- Design that was received from me through trade can only be traded or gifted. DO NOT SELL MY TRADE/DESIGN that I gave to you.
- Don’t make your own closed species based of any of my designs (non-cs / cs , etc)Closed species
- If a new species is created by me, with specific traits and information, you CAN’T do your own for any reason.
- You CAN’T change or modify their specific traits that make them, be my closed species. no matter how much you paid, if really want make it different, need to discuss it with me, before you buy. I have the rights of my closed species, so anybody that want make a fake copy, etc, taking a heavy reference, will be reported and blocked.10. RightsI reserve the right to refuse a commission for any reason, and I am not obligated to provide a reason as to why. (No matter if I accepted other commissions from the same person in the past)I reserve copyrights to my artwork, even if the work has the characters of someone else. I have the right to post, reproduce, copy, and distribute for promotional purposes. (like do a banner to promote my art, use it as icon to promote my art page, post it in my gallery, etc)You can post the commission i did to you in any public or personal gallery, ALWAYS giving credit to me. You can print your commission too, as long is for PERSONAL USE ONLYNEVER delete my signature of any art piece to post it in any place.I reserve the right to sell or use rejected custom designs (ONLY the pose and NOT your character)11.
